Pfizer Inc. (PFEI: PFEI) and its other drugmakers, which include Bayer HealthCare (BHC), Pfizer Inc. and Merck & Co. Inc., all agreed on Thursday to end their patents on the weight-loss drug Xenical, which treats obesity. The patents will expire in April 2020, Pfizer’s patent expires on Jan. 1, 2021, and Merck & Co.’s patent on the drug is expected to expire on Sept. 30, 2022. The drug’s patents in both countries were set to expire in 2012, the companies said. The patents in the United States were scheduled to expire in 2017. In Canada, the drugmaker said it will be filing lawsuits against the companies in Canada and other countries for overcharging for the drug. It did not disclose its full list of lawsuits, but a spokeswoman said the Canadian patent is the only one that is set to expire in Canada. Merck and Pfizer, which have been fighting the drugs for years, had a joint press conference Wednesday morning to announce the deal.
Xenical and its generic drug product, orlistat, were among the top 20 drugs by sales in the U. S. in 2012 and 2013, according to IMS Health, the company that makes Xenical. Both companies are known as Alli, orlistat, and are part of the Alli family of drugs. Xenical was the first drug approved for weight loss in the U. by the Food and Drug Administration in 1999, which led to widespread usage of Xenical. The drug has gained attention for its ability to reduce appetite, boost metabolism, reduce fat absorption, and prevent obesity-related health problems.
